The High Court of Cassation and Justice, sitting as the Full Bench for Resolving Legal Issues, resolved a conflict of laws by ruling that the requirement that budgetary claims must be less than 50% of the total declared debts is inapplicable to insolvency petitions filed by a liquidator appointed under the 1990 Companies Law. The court addressed a referral from the Bucharest Court of Appeal concerning the interpretation of Article 5(1)(72) of Law No. 85/2014 (as amended by Emergency Ordinance No. 88/2018), determining that this specific statutory threshold does not apply when the request for opening insolvency proceedings is initiated by a statutory liquidator. This decision serves as a binding legal interpretation for all lower courts, clarifying the procedural prerequisites for initiating insolvency proceedings in cases involving entities subject to liquidation under company law.
