Scope of tax exemption for construction works: limited to public utility expropriation projects under Law 255/2010
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice admitted the preliminary referral from the Court of Appeal Craiova and established a mandatory interpretation of Article 25(2) of Law No. 255/2010 (pre-2018 amendments), ruling that the exemption from taxes payable to the State Construction Inspectorate applies exclusively to works executed in connection with expropriation for public utility purposes within national, county, or local development projects managed by specific central ministries or the National Agency for Mineral Resources. The dispute concerned the scope of this tax exemption in a civil proceeding, clarifying that it does not extend to works outside the defined public utility expropriation framework. The decisive legal basis is the interpretive application of Law No. 255/2010, Article 25(2), in conjunction with the mandatory authority of binding interpretations under Article 521(3) of the Civil Procedure Code, which restricts the tax waiver to specific government-led infrastructure and resource projects.
