The High Court of Cassation and Justice admitted the referral for a preliminary ruling on a question of law and established that Article 832 of Law No. 303/2004 on the status of judges and prosecutors, as introduced by Law No. 118/2014, does not apply to convictions for offenses committed before its entry into force; the ruling is binding under Article 521(3) of the Civil Procedure Code. The referral came from the Bucharest Court of Appeal in a labor and social insurance dispute (case No. 19522/3/2018), challenging the temporal application of the provision. The decisive legal basis is the principle of non-retroactivity of law, holding that the contested provision—which addresses the effect of criminal convictions on judicial or prosecutorial tenure—cannot operate retroactively to cover pre-enactment offenses, thus clarifying the scope of Article 832 for future applications.
