Ex lege classification of anatomy and pathology staff as special conditions workplaces without administrative methodology under Law No. 104/2003
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the public interest filed by the Ombudsman, thereby establishing a binding unitary interpretation that mandates the ex lege classification of specific workplace categories. The dispute concerned whether positions held by personnel in hospital pathology services, prosection rooms, and university departments of anatomy, histology, and cellular biology must be classified as "workplaces under special conditions" through the administrative methodology prescribed by Government Orders No. 261/2001 and No. 246/2007, or if such classification is automatic. Relying on Article 22 of Law No. 104/2003 regarding the manipulation of human corpses and organ retrieval for transplantation, the court ruled that these roles are ex lege classified as special conditions workplaces, rendering the procedural steps for methodology-based classification unnecessary and obsolete for these specific positions.
