The Supreme Court of Romania rejected as inadmissible the reference for preliminary ruling submitted by the Cluj Court of Appeal, meaning the referring court's question remains unanswered by the highest instance and the procedural status quo from the lower instance persists. The dispute involved a request to clarify the legal interpretation of the terms “estimated value of the contract” and “stated value of the contract” under Article 611(1) of Law No. 101/2016, which governs remedies and appeals in public procurement matters. The decisive legal basis for the dismissal was the procedural inadmissibility of the session, rendered by the High Court's panel for resolving questions of law pursuant to Article 521(3) of the Code of Civil Procedure.
