The High Court of Cassation and Justice (Civil Section I) declined its own jurisdiction and transferred the case to the Suceava Court of Appeal, which prevailed as the competent forum; the petitioner’s request to transfer (“strămutare”) the underlying case pending before the Suceava Tribunal to another equal court, based on legitimate suspicion, was not decided on the merits and remains pending before the appellate court. The dispute involved a procedural motion under Article 142(1) of the Romanian Code of Civil Procedure, which assigns jurisdiction over transfer requests based on legitimate suspicion to the court of appeal when the lower court (here, a tribunal) is within its circuit; applying Article 132 C. proc. civ., the High Court determined it lacked material jurisdiction and ordered the file sent to the Suceava Court of Appeal, with no appeal available against this ruling.
