The High Court of Cassation and Justice dismissed the appeal filed by the Pension House, upholding the lower court’s judgment that awarded the claimant the rights of a persecution victim under the applicable legislation. The dispute concerned the annulment of an administrative decision that recognized the claimant as a beneficiary of relief measures for the period from March 20, 1944, to March 6, 1945, rather than the entire period of forced displacement from September 6, 1940, to March 6, 1945. The claimant challenged the limitation of the recognition period, while the respondent argued that only the later period was substantiated. The court held the appeal unfounded, relying on Article 1, paragraph 1, letter c) of Government Ordinance No. 105/1999, approved by Law No. 189/2000, which protects citizens subjected to ethnic persecution through forced resettlement. The decisive finding was that the claimant, who was an infant at the time of the initial relocation from Bessarabia, could not be legally separated from their mother, whose continuous displacement had already been established; therefore, the claimant was entitled to recognition for the full duration of the regime from September 1940 to March 1945.

Asupra recursului de față;
