Jurisdictional declination for transfer motion based on legitimate suspicion against tribunal
Legislator summary
AI generatedThe High Court of Cassation and Justice declinéd jurisdiction over the case, ruling that the matter is without prejudice and referring it to the Bucharest Court of Appeal; no party "prevailed" on the merits, as the decision was purely procedural. The dispute arose when a petitioner filed a motion to transfer a civil case pending before the Bucharest Tribunal to a different court of equal rank due to legitimate suspicion (bias). The decisive legal basis was Article 142(1) of the Civil Procedure Code, which mandates that transfer motions based on legitimate suspicion against a district court or tribunal must be adjudicated by the competent court of appeal within the same jurisdiction, thereby establishing that the High Court lacked subject-matter jurisdiction to hear the request.
