Recourse in the public interest allowing interpretation of statute of limitations for administrative compensation claims
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the Full Bench for Recourse in the Public Interest, granted the recourse filed by the General Prosecutor, establishing a binding interpretation of administrative liability law. The dispute concerned the calculation of the statute of limitations for compensation actions arising from illegal administrative acts, specifically whether the limitation period begins at the communication of the act or the finality of the annulment decision. Relying on Article 19 of Law No. 554/2004 in conjunction with Article 11(2), the Court ordered that the prescription period begins at the moment the injured party knew or should have known the extent of the damage, explicitly decoupling the start of the limitation period from both the initial notification of the illegal act and the subsequent finality of any annulment judgment.
