The High Court of Cassation and Justice dismissed as inadmissible the referral filed by the Bucharest Court of Appeal, thereby preventing the establishment of a preliminary ruling on the specific legal question. The dispute concerned the applicable statute of limitations for the enforcement of civil compensation claims established in favor of public authorities against military personnel, arising from civil actions processed within criminal proceedings under Government Ordinance No. 121/1998 regarding material responsibility of military personnel. The court's decision rests on procedural admissibility criteria, specifically interpreting the requirements for the referral of a legal question under Article 521(3) of the Code of Civil Procedure, which mandates that such referrals be handled in a mandatory manner when specific conditions are met, but here found the referral insufficient to meet the threshold for a binding preliminary ruling.
