The Romanian High Court of Cassation and Justice dismissed as unfounded the appeal filed by the County Pension House, thereby upholding the lower court's judgment in favor of the claimant. The lower court had annulled the pension authority's decision denying benefits and ordered it to recognize the claimant as a beneficiary under Emergency Ordinance No. 105/1999, as approved by Law No. 189/2000. The dispute arose when the claimant sought those benefits on the ground that her parents had been ethnically persecuted and forced to relocate from Oradea to Bucharest in 1941 during the regime period covered by the ordinance, with the claimant being born during that displacement in 1943. The court rejected the pension authority's argument that the law had been misapplied, holding that under Article 1(c) of the ordinance, persons forcibly relocated from their domicile for ethnic reasons during September 6, 1940 – March 6, 1945, are beneficiaries, and since the claimant's parents' relocation was proven and she was born during that period, she shared their status as a relocated person and was entitled to the statutory rights.

Asupra recursului de față;
