The High Court of Cassation and Justice dismissed the preliminary ruling request filed by the Bucharest Court of Appeal as inadmissible. The dispute concerned whether Article 24(2) of Law No. 165/2013 applies to an assignee of disputed rights who was a beneficiary of a final judgment issued exclusively under Law No. 10/2001, prior to the entry into force of Law No. 165/2013, where the damages amount had not been reduced by any legal provision before the latter law took effect. The decisive legal basis is the procedural framework governing the admissibility of preliminary rulings under the Civil Procedure Code, specifically the criteria for the High Court to intervene in matters of uniform interpretation of law.
