The High Court of Cassation and Justice rejected as inadmissible the preliminary ruling request submitted by the Cluj Court of Appeal regarding labor and social security litigation. The dispute centered on the interpretation of Article 11(1) of Emergency Government Ordinance No. 90/2017, as amended by Law No. 80/2018, in conjunction with Article 44 of Framework Law No. 153/2017 on the salarization of public employees. Specifically, the referring court sought clarification on the legal status of aids and indemnities upon retirement, resignation, termination of service, or transfer to reserve after July 1, 2017, the date when such rights were repealed by the framework law. The High Court found the session for resolving this specific issue of law inadmissible, thereby leaving the procedural resolution of the underlying case to the lower court without a definitive interpretation from the supreme jurisdiction.
