Peremption of cassation appeal due to one-year procedural inactivity
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appellant's cassation appeal perempted, leaving the lower court's judgment dismissing the claim in force. The dispute arose from an administrative-law action filed by a company against the Ministry of Interior and the General Inspectorate of the Romanian Police, challenging a prior decision; the appeal was deemed abandoned because the parties unjustifiably failed to appear at the hearing and no procedural acts to interrupt or suspend the time limit were performed for one year. Relying on Articles 248 and 252 of the Code of Civil Procedure, the court determined that the appeal perished ex lege due to inactivity attributable to the party, resulting in the automatic peremption of the appeal without a substantive review on the merits.

Asupra cererii de faţă;
252 alin. (1) din C. proc. civ. şi va constata perimat recursul.
