The High Court of Cassation and Justice dismissed the appellant's appeal, thereby upholding the Court of Appeal's decision which had previously rejected the claimant's action against the Government. The dispute concerned the validity of a government decree that transferred a specific parcel of land from the public to the private state domain and authorized the creation of a mixed-capital commercial society for a cultural-sport complex, with the claimant arguing the state never validly acquired the land and the intervening state entity contending former owners had been indemnified and resettled. The appellate decision to reject the suit remains in force because the government decree under challenge was expressly abrogated by a subsequent government decree, rendering the analysis of its legality and merits moot.

Asupra recursului de față;
