Continued application of 1969 Penal Code revocation regime for conditional suspensions under intertemporal application of lex mitior
Legislator summary
AI generatedThe High Court of Cassation and Justice issued a binding decision resolving a question of law raised by the Bucharest Court of Appeal, establishing that the legal regime for conditional suspension of sentence execution under Article 81 of the 1969 Penal Code remains applicable to sentences pronounced after the entry into force of the current Penal Code (February 1, 2014), even when the suspension was ordered based on the application of the more favorable law. The dispute concerned whether the 1969 Penal Code rules, which provided a more favorable regime regarding revocation or annulment of conditional suspension, continued to govern cases where a defendant committed a new offense during the probation period, despite the new Penal Code having entered into force. The court determined that the decisive legal basis was the principle of intertemporal application of the more favorable penal law (lex mitior), mandating that the procedural and substantive conditions for revocation or annulment of a conditional suspension originally established under the 1969 law must be preserved, regardless of the date of the subsequent judgment or the specific type of penalty applied for the new offense.
