Noise-Limit Referral on Preliminary Ruling Declared Inadmissible; Underlying Administrative Case Left Unresolved
Legislator summary
AI generatedThe Romanian High Court of Cassation and Justice dismissed as inadmissible a referral seeking a preliminary ruling on legal questions, thereby leaving the referring court’s pending administrative case (docket no. 14196/55/2017) unresolved on the merits. The referral, made by the Arad Tribunal (Third Section for administrative, fiscal, labor, and social insurance disputes), asked whether the noise-limit provisions of Ministry of Health Order no. 119/2014 should be read together with Articles 2(26) and 2(27) of Law no. 61/1991 (which sanction disturbances of public order and tranquility), and whether the intensity of noise required for liability must be established objectively through certified technical means. The High Court refused to answer on procedural grounds, ruling that the conditions for a preliminary ruling under Article 521(3) of the Civil Procedure Code were not met; the decision is binding but does not settle the underlying dispute or the substantive interpretation of the cited norms.
