The High Court of Cassation and Justice resolved a negative jurisdictional conflict by ruling that Tribunalul Dolj is competent to hear the customs tax challenge filed by a company against the customs assessment act and related late-payment penalty notice. The lower court (Court of Appeal) had declined jurisdiction in favor of the tribunal, while the tribunal had previously declined in favor of the court of appeal. The decisive ground was that the disputed documents, though bearing the letterhead of the General Customs Directorate, were issued and signed by the Craiova Customs Office, a regional body; therefore, under Art. 2(1)(c) of the Civil Procedure Code and Arts. 174 and 182 of the Fiscal Procedure Code in force at the time the action was filed, material jurisdiction lies with the tribunal, not the court of appeal. The court ordered the case file transferred to Tribunalul Dolj for adjudication.

Asupra conflictului negativ de competență de față;

22 C. proc. civ.
