Transfer of case for legitimate suspicion referred to competent court of appeal as material incompetence sustained.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the exception of its own material incompetence and referred the applicant's request for the transfer (strămutare) of Case No. x/2018 pending before the Calafat Court of First Instance to the Craiova Court of Appeal for resolution, with no appeal available. The dispute concerned a request to transfer a case filed after the entry into force of the new Civil Procedure Code, based on legitimate suspicion. The decisive legal basis was Article 142(1), first thesis, of the Civil Procedure Code, which provides that a request for transfer based on legitimate suspicion falls within the jurisdiction of the court of appeal when the court from which transfer is sought is a first-instance court or tribunal within its circuit, applied together with Article 24 of the same code; the High Court thus declined jurisdiction in favor of the competent appellate court.
