The Supreme Court of Appeals and Justice (High Court of Cassation and Justice) admitted the appeal filed by the defendant National Authority for Roads, quashed the lower court's judgment, and recorded the plaintiff's withdrawal of the claim, effectively terminating the litigation in favor of the defendant. The dispute arose in administrative and fiscal litigation where a commercial company sought to compel the defendant to reanalyze its decision and refund the value of unused road usage stickers (rovignettes), arguing that the defendant had incorrectly applied the regulations for vehicles with four or more ax; the first-instance court had previously admitted the action and annulled the administrative act. The High Court resolved the procedural status of the case based on Article 246 of the Civil Procedure Code, noting that the plaintiff had expressly waived the trial of the action via a motion filed in May 2004, thereby rendering the substantive arguments regarding the defendant's status as an administrative authority or the nature of the contractual relationship moot.

Asupra recursului de față;

Din examinarea lucrărilor din dosar, constată următoarele:

Prin acțiunea înregistrată la 12 iunie 2003, reclamanta SC I.T. SRL Cluj Napoca a chemat în judecată R.A. A.N.D.

Împotriva acestei soluții a declarat recurs, pârâta R.A. A.N.D.
