Pension house appeal rejected; military labor service recognized for survivor benefits under Law 309/2002.
Legislator summary
AI generatedThe court dismissed the pension house's appeal as unfounded, affirming the lower court's judgment that had granted the widow's claim and ordered the pension house to award the benefits under Law No. 309/2002 based on her late husband's military labor service. The dispute arose from the pension house's refusal to recognize the deceased's 1957–1959 military stint as work detachments, despite his work as a carpenter in a railway bridge battalion, arguing the military record lacked the "work detachment" notation. Decisively, the court held that the absence of that notation was inconclusive because the labor service directorate was then subordinated to the construction ministry, so the record could only mention a military unit; the other entries proved the service was performed through labor. The ruling applies procedural law (Art. 304 point 9 and Art. 306(2) Code of Civil Procedure) and the substantive entitlement under Law No. 309/2002, finding no grounds for cassation.

Asupra recursului de față;
306 alin. (2) C. proc. civ.
