The High Court of Cassation and Justice (Romania) admitted the referral from the Alba Iulia Court of Appeal and ruled, in a preliminary ruling for the resolution of a legal question, that the legality or illegality of a defendant’s pretrial deprivation of liberty cannot be established through an appeal against execution (contestație la executare) based on Article 598(1)(d) or Article 598(1)(c), first thesis, of the Criminal Procedure Code, when the final acquittal decision did not already rule on that issue. The court thus answered the question in the negative, holding that such a determination may not be made via that procedural route. The referral arose from two cases involving acquitted defendants who sought compensation under Article 539(2) of the Criminal Procedure Code for unlawful pretrial detention, but the acquittal courts had not addressed the legality of that detention. The High Court reasoned that the legal framework assigns the assessment of deprivation of liberty’s legality exclusively to the court that issued the final acquittal, and the procedural avenues under Article 598(1)(c) and (d) are limited to specific execution-related matters, not to a fresh evaluation of pretrial detention’s legality. The ruling is binding from its publication in the Official Gazette of Romania, per Article 477(3) of the Criminal Procedure Code.
