The High Court of Cassation and Justice declared the appellant's appeal (recurs) perished, rendering the decision final and leaving the lower court's procedural suspension order in force. The dispute involved a challenge to an appellate court order that had suspended the proceedings in an administrative-fiscal case due to the parties' unjustified absence; the appeal itself remained dormant for one year without any procedural acts to interrupt or suspend the time limit. Relying on Articles 248(1) and 252(1) of the Code of Civil Procedure, which mandate the automatic peremption of appeals if they remain unprocessed for a year due to the party's fault, the court found no valid interruption occurred and thus ruled the appeal void.

Asupra cererii de faţă;

252 alin. (1) din C. proc. civ. şi va constata perimat recursul.
