The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Tribunal of Vrancea, rejecting the request for a binding interpretation of Romanian traffic law. The dispute concerned whether Article 191 of the Regulation implementing Emergency Government Ordinance No. 195/2002 constitutes a special norm derogating from the general rule in Article 109(1) of the same Ordinance, specifically regarding the competence of the head of the road police service in the county where the traffic violation was committed versus the county where the offender is registered for the purpose of applying complementary contraventional sanctions.
