The High Court of Cassation and Justice declined jurisdiction, ordering the case to be transferred to the Brașov Court of Appeal for a final determination; this procedural decision is final and not subject to appeal. The dispute involved a petition by an individual to transfer a civil case pending before the Brașov Tribunal to a different court on grounds of legitimate suspicion (bias), accompanied by an incidental request for legal aid. The decisive legal basis was Article 142(1) of the Code of Civil Procedure, which mandates that applications for case transfer based on legitimate suspicion are within the material competence of the appellate court when the originating instance is a county court or tribunal within its jurisdiction, rendering the High Court incompetent to rule on the merits.
