Decriminalization of evasion from safety measures: Inapplicability of new code's complementary penalty evasion to abrogated 1969 Code prohibitions
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the Complete Panel for Resolving Questions of Law in Criminal Matters, ruled that the act of evading the execution of a safety measure (prohibition from staying in certain localities) under the former 1969 Penal Code does not fulfill the elements of the crime of evasion from the execution of a complementary penalty under Article 288(1) of the current Penal Code, thereby effectively finding the act decriminalized or non-punishable under the new legislation. This decision resolved a reference from the Bucharest Court of Appeal regarding whether evasion of the old code's safety measure is prosecutable as evasion of the new code's specific complementary penalty (defined in Article 66(1)(l)) following the abrogation of the 1969 Code on February 1, 2014. The decisive legal basis rests on the principle of typicity, establishing that the specific legal nature of the former "safety measure" under Article 112(d) of the 1969 Penal Code is not equivalent to the "complementary penalty" under Article 66(1)(l) of the 2014 Penal Code, thus precluding the application of Article 288(1).
