The High Court of Cassation and Justice dismissed as inadmissible the connected referral requests filed by the Bucharest Court of Appeal, thereby preventing the issuance of a preliminary ruling on the legal question regarding the admissibility of appeals in monetary disputes valued up to 1,000,000 RON. The underlying dispute concerned whether appeals against judgments rendered after the publication of Constitutional Court Decision No. 369/2017, in cases initiated prior to that date but pending as of the publication of Constitutional Court Decision No. 454/2018, remained inadmissible under the judicial competence limitations established by Article 27 of the Civil Procedure Code in conjunction with Article 147(4) of the Romanian Constitution and ICSJ Decision No. 52/2018. The operative outcome leaves the lower courts' interpretations of these procedural competence and admissibility constraints in force, with the decision rendered mandatory under Article 521(3) of the Civil Procedure Code.
