The High Court of Cassation and Justice declined its competence and transferred the case to the Bucharest Court of Appeal, which prevails as the competent forum. The applicant had filed a request for the transfer (strămutare) of a case pending before the Roșiori de Vede District Court, citing legitimate suspicion. Because the underlying case was registered after the entry into force of the new Civil Procedure Code, the court applied Articles 131 and 142(1) of that code, holding that a transfer request based on legitimate suspicion against a district court or tribunal falls within the material competence of the court of appeal in whose circuit the lower court sits; here, that was the Bucharest Court of Appeal. The decision is final.
