Misdirected petition for annulment against a Court of Appeal decision and lack of material jurisdiction for the Supreme Court.
Legislator summary
AI generatedThe Supreme Court ordered the transfer of a petition for annulment (contestaţie în anulare) from the High Court of Cassation and Justice to the Piteşti Court of Appeal, Section II Civil, of Administrative and Fiscal Litigation, thereby declaring itself materially incompetent and leaving the initial appellate decision pending adjudication by the competent jurisdiction. The dispute arose when a litigant filed a petition for annulment against a civil appellate decision regarding administrative litigation, but the respondent raised a preliminary exception of lack of material jurisdiction. The Court determined that the petition was improperly filed with the Supreme Court because, under Article 319(1) of the Code of Civil Procedure, such petitions must be lodged with the court that issued the attacked decision, and because Article 503 of the newly codified Code of Civil Procedure did not apply to the case, with the old procedural code governing instead; consequently, the Court relied on Article 159 of the Code of Civil Procedure to refer the case to the Piteşti Court of Appeal for competent resolution.
