The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling on questions of law submitted by the Bucharest Court of Appeal. The underlying dispute concerned the statute of limitations and the survival of subjective rights for an entitled person seeking the resolution of a notification under the legal framework for the restitution of property expropriated during the communist era, specifically after the six-month deadline for the holding unit to act had expired. The court ruled on the admissibility of the referral based on procedural requirements, rejecting the request without examining the substantive interpretations of Article 33(1) and Article 35(2) of Law No. 165/2013 or the interplay with Law No. 10/2001, leaving the lower court to determine the matter under existing jurisprudence and statutory provisions.
