The High Court of Cassation and Justice admitted the joined referrals and, in a preliminary ruling on a question of law, held that negotiations concerning the classification of work in groups I and/or II (special and/or deosebite conditions) cannot be the subject of mediation under Law No. 192/2006 on mediation. The ruling is binding under Article 521(3) of the Civil Procedure Code. The dispute arose from three civil cases before the Ploiești Court of Appeal, where the issue was whether disputes over the legal right to have work experience recognized as performed under special or deosebite conditions could be settled through mandatory mediation. The Court reasoned that such classification is a legal determination based on legislative criteria, not a matter of free negotiation between parties, and therefore falls outside the scope of mediation.
