The Supreme Court of Romania (High Court of Cassation and Justice), sitting as the Chamber for Resolving Legal Issues, dismissed as inadmissible the request for a preliminary ruling submitted by the Bacău Court of Appeal. The dispute concerned a civil matter involving the unilateral termination of a contract by the management bodies of a legal entity, specifically challenging whether such an act, in the absence of statutory or contractual authorization, constituted an illicit juridical act or legal fact under Article 35 of Decree No. 31/1954 regarding natural and legal persons. The court’s decision, rendered pursuant to Article 521(3) of the Code of Civil Procedure, results in the rejection of the specific legal question without a substantive ruling on its merits, leaving the underlying procedural status of the lower court's case unaffected by this specific high-court intervention.
