The High Court of Cassation and Justice admitted the referral from the Bacău Court of Appeal and issued a preliminary ruling, establishing that the law applicable to the right to compensation from the state following an acquittal rendered after a final conviction is the law in force at the time the acquittal became final, determined according to the rules of the 1968 Criminal Procedure Code (arts. 416–417) or the 2010 Criminal Procedure Code (arts. 551–552). The ruling is binding under art. 521(3) of the Civil Procedure Code, resolving the interpretive question raised in the underlying civil case. The dispute concerned which temporal version of the criminal procedure law governs the state’s liability for damages caused by a wrongful conviction, and the court answered by anchoring the applicable law to the date of the final acquittal judgment, rather than the conviction date or other events.
