The High Court of Cassation and Justice rejected the request for a preliminary ruling as inadmissible, leaving the procedural question unresolved by this specific decision. The dispute concerned whether the preliminary procedure for administrative contracts under Law No. 554/2004 remained mandatory after the express abrogation of the corresponding provision in the old Code of Civil Procedure, specifically in actions for nullity, annulment, execution, or rescission of administrative contracts initiated by public authorities or upon recommendation by control bodies. The decisive legal basis for the rejection was Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements for references to the Complete Bench for resolving questions of law.
