The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal Pitești, thereby leaving the lower court's position to determine the application of the law without a binding supreme court interpretation. The dispute concerned the legal characterization of a restitution request under the regime for the recovery of abnormally seized properties, specifically whether such a request constitutes an acceptance of succession only upon completion of the entire procedural framework, including filing an objection against a rejection of restitution in kind, or whether it serves merely as a preservation act on behalf of all heirs who initiated the claim. The decisive legal issue centered on the interpretation of Articles 4(3)-(4) and 26(3) of Law No. 10/2001 regarding the legal regime of immovable properties abnormally seized between March 6, 1945, and December 22, 1989, in relation to the succession rights and procedural obligations of co-heirs.
