The High Court of Cassation and Justice, acting as the panel for resolving legal questions, admitted a reference from the Court of Appeal and issued a binding interpretation establishing that claims filed by non-employee creditors with debts preceding the opening of insolvency proceedings must be submitted to the court within the deadline set in the opening decision and recorded in a register kept at the court registry. This ruling resolves a procedural dispute regarding the correct venue and method for filing such claims under the new insolvency legislation, specifically addressing whether these applications belong in the court or with the liquidator. The decisive legal basis is the interpretation of Article 102(1), first and second sentences, of Law No. 85/2014, read in conjunction with Article 521(3) of the Code of Civil Procedure, which mandates that the submission to the tribunal and registration at the clerk's office are compulsory requirements for the admissibility of these pre-existing creditor claims.
