The High Court of Cassation and Justice admitted the referral from the Pitești Court of Appeal for a preliminary ruling and held that, under Article 169¹(3) of Law No. 263/2010 (as inserted by Law No. 192/2015), the phrase "complete contribution periods provided by law, corresponding to each situation" refers to the law in force at the date of pension recalculation when the points increase is granted—namely Law No. 263/2010. The decision is binding under Article 521(3) of the Civil Procedure Code, and it resolves a dispute over whether prior pension legislation or the current law governs the recalculation of pensions with the points increase, clarifying the applicable legal framework for such recalculations.
