The High Court of Cassation and Justice rejected as inadmissible the referrals from the Constanța Tribunal (Civil Section I) in cases nos. 25171/212/2017 and 25185/212/2017, seeking a preliminary ruling on whether meal-ticket allowances under Law No. 142/1998 constitute a salary right and whether damages for their non-grant are salary rights; thus, no ruling was issued on the merits, and the referring court’s questions remain unresolved. The dispute involved civil litigation over the legal classification of meal-ticket benefits and related compensation for non-provision, challenged through a preliminary-ruling procedure under Article 521(3) of the Civil Procedure Code. The decisive basis was the inadmissibility of the referral, as the questions did not meet the statutory admissibility requirements for a preliminary ruling, leading to rejection without addressing the substance of the interpretative issue.
