The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal—Administrative and Fiscal Section—seeking a preliminary ruling on whether the monthly difficulty allowance of up to 50% of base salary under Article II of Law No. 263/2006 is payable to members of land fund commissions only for the one-year period from 3 July 2006 to 3 July 2007 or for the entire duration of their activity, with annual beneficiary determination by the institution head. The court ruled on the admissibility of the referral procedure under Article 521(3) of the Civil Procedure Code, finding the request did not meet the legal conditions for a preliminary ruling, without resolving the substantive interpretation of Article II. The referral was rejected, leaving the lower court's pending case unaffected by a preliminary ruling on this issue.
