The High Court of Cassation and Justice dismissed the criminal appeal as inadmissible, ordering the appellant to pay 600,000 lei in judicial expenses to the state. The dispute concerned the procedural admissibility of an appeal against a lower court's decision to join four related criminal cases, which the appellate court had previously rejected on the grounds that such procedural rulings could only be challenged together with the final judgment. The court held that the Military Court of Appeal had acted as a court of cassation (recurs) rather than a court of appeal, meaning its decision was not subject to a further appeal under the relevant provisions of the Code of Criminal Procedure; consequently, no new appeal could be filed against that specific judgment. The decisive legal basis included Article 3851 letters c) and e) of the Code of Criminal Procedure regarding the scope of appealable decisions and Article 38515 point 1 letter a) for the dismissal of the inadmissible petition.

Asupra recursului penal de față;

38515 pct. 1 lit. a) C. proc. pen.

Conform art. 192 alin.
