Legislator summary

AI generated

The High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling requested by a lower civil court, thereby upholding the procedural status quo regarding the interpretation of the phrase "continuation of studies" under Article 499(3) of the Civil Code. The dispute arose from a civil matter requiring clarification on whether the legal term encompassed specific educational scenarios, prompting the referring court to seek a uniform interpretation from the Specialized Panel for Resolving Questions of Law. The decisive legal basis for the rejection was the procedural inadmissibility of the reference under Article 521(3) of the Code of Civil Procedure, meaning the court did not reach the merits of the substantive interpretation but ruled on the procedural validity of the referral mechanism itself.
