The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Bucharest Court of Appeal. The dispute concerned the interpretation of the prescription period for filing compensation claims in administrative litigation, specifically whether the term begins running from the communication of the illegal administrative act or from the finality of the judicial decision annulling that act. The court’s decision relies on Article 19 and Article 11(2) of Law No. 554/2004 (Administrative Procedure Code) regarding the calculation of prescription, in conjunction with Article 521(3) of the Code of Civil Procedure governing the admissibility of referrals to the Complete Court.
