The High Court of Cassation and Justice dismissed as inadmissible a referral from the Bucharest Court of Appeal seeking a preliminary ruling on whether a ruling to close a disciplinary complaint against a magistrate—issued by the Judicial Inspection under Article 47(1)(b) of Law No. 317/2004—could be challenged before that appellate court not only by the complainant but also by the magistrate who was the subject of the complaint, given the legislative gap following Constitutional Court Decision No. 397/2014 and Article 5(3) of the Civil Procedure Code applied by analogy. The court refused to answer the question on the merits, thereby leaving the referring court’s underlying case unresolved and the challenged closure ruling in force. The dismissal was based on procedural admissibility grounds under Article 521(3) of the Civil Procedure Code, without reaching the statutory interpretation of Law No. 317/2004 or the applicable review mechanism.

Minuta deciziei nr. 60 Dosar nr. 1316/1/2018

Şedinţa din 24 septembrie 2018

DECIDE:
