The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal seeking a preliminary ruling on whether Article 37(5) of Law No. 50/1991 on construction authorization constitutes a bar to acquiring ownership of a building through artificial accession; the dismissal leaves the appellate court to resolve the underlying dispute without a binding interpretive ruling, and the decision is binding under Article 521(3) of the Civil Procedure Code. The case involved a civil appeal concerning property ownership over a construction built without the required permit, raising the question of whether the statutory prohibition on recognition of unauthorized works prevents the application of the accession doctrine. The court held the referral inadmissible, reasoning that the legal issue did not meet the statutory conditions for a preliminary ruling, as it did not present a genuine question of law requiring uniform interpretation and lacked the requisite novelty or difficulty, thereby declining to address the merits of the accession analysis.
