The High Court of Cassation and Justice ordered the correction of a material error in the operative part of its prior decision, granting the petition for rectification filed by a party. The dispute concerned a clerical omission in the legal standard established by the Court regarding the finality of enforcement orders; specifically, the original text failed to explicitly include obligations that are not assessable in money. The decisive legal basis is Article 906, paragraphs (1) and (2) of the Civil Procedure Code, which governs the final nature of the enforcement court's decision on a creditor's request to obligate a debtor to pay daily late-payment penalties for non-assessable obligations of doing or not doing that cannot be performed by another person.
