The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal of Suceava. The dispute concerned whether a private physician operating within a commercial entity that holds a service contract with the National Health Insurance House falls under the definition of a "public official" for the purposes of the crime of bribery under Article 289(1) of the Penal Code. The reference was based on the second part of Article 175(2) of the Penal Code, which extends the status of public official to persons in private sector roles performing public services under contract, but the Supreme Court found the referral procedurally defective and did not rule on the substantive legal question, leaving the original appeal proceedings pending without a binding interpretation from the higher court.
