The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary decision on a question of law submitted by the Court of Appeal of Constanța, leaving the lower court's procedural posture unchanged. The dispute concerned the interpretation of the absolute prohibition against suspending criminal trial proceedings under Art. 367(9) of the Code of Criminal Procedure, specifically whether this ban applies at the stage of merely invoking a unconstitutionality exception or only upon the actual referral of the exception to the Constitutional Court under Art. 29 of Law No. 47/1992. The Court’s decision was based on the procedural admissibility requirements for such referrals, effectively rejecting the appellate court's attempt to resolve the ambiguity between "invoking" and "referring" a constitutional challenge within criminal proceedings.
