Legislator summary

AI generated

The Supreme Court rejected the reference for preliminary ruling as inadmissible, thereby leaving the lower court's proceedings unaffected. The dispute concerned a procedural question raised by the Suceava Court of Appeal, specifically whether the 10-day deadline stipulated for the prosecutor's decision in cases where criminal liability is extinguished constitutes a statute of limitation (peremption) or a mere recommendation. The decisive legal basis was the procedural rules governing the admissibility of requests for clarifying decisions on matters of law under the Code of Criminal Procedure, which led the Court to determine that the request did not meet the requirements for a binding principle-binding decision.
