The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for the resolution of questions of law, rejected as inadmissible the referral filed by the Bucharest Court of Appeal – Eighth Administrative and Fiscal Litigation Section in case no. 31173/3/2015, thereby refusing to provide a preliminary ruling on the legal questions raised, with the referral being declared inadmissible and no substantive decision rendered on the merits. The underlying dispute concerned an administrative and fiscal litigation matter in which the referring court sought clarification on certain legal issues. The court based its decision on the procedural requirements for such referrals, holding that the conditions for admissibility under the applicable provisions were not met, thereby leaving the prior proceedings and any existing rulings unaffected and the referral dismissed without prejudice.
