Legislator summary

AI generated

The Supreme Court dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal, resulting in no substantive legal resolution on the merit of the fiscal dispute. The procedural dispute concerned a referral under the fiscal administrative litigation code to interpret the provisions of Article 3 in relation to Article 1(b) of Law No. 12/1990 on protecting the population against illicit production, commerce, or service activities. The decisive legal basis was the procedural requirement of Article 521(3) of the Civil Procedure Code, which mandates that the Court of Final Instance issues a binding mandatory decision on referred legal questions, leading to the inadmissibility of the specific reference made by the lower court.
